You must agree to our following terms and policy. Please make sure to go through the following:

Acceptable Use Policy

General Contract Terms

During the term of his/her web hosting agreement with EHostOne.com, Customer must ensure that the use of any quality web hosting resource offered to Customer or owned or controlled by EHostOne.com ("Service") conforms with EHostOne.com's then current Acceptable Use Policy ("AUP"). EHostOne.com may modify, without prior notice, the AUP as EHostOne.com deems appropriate. Such modified AUP is effective upon posting on EHostOne.com's website.

Web Hosting Accounts

You may only host one domain name per account. Pointing other domains to your account, or pages within your existing web site is not acceptable and is grounds for termination, unless your account is a multi-domain hosting. Customer may exceed monthly bandwidth included with the web hosting package. If bandwidth is exceeded, your account will be charged for additional bandwidth usage.

Domain Registration/Transfer

Domain registration is FREE only for professional, platinum, premium plans with yearly signup.

Payment Policies:

EHOSTONE preferred method of payment is credit card.

By purchasing our hosting services, you are agreeing to allow EHOSTONE to place your account on a recurring payment plan. The account will automatically be re-billed according to the terms of the plan you select.

You grant EHOSTONE permission to charge your credit card for any and all services you request, including, but not limited to, hosting and/or domain name renewals.

If we are unable to process a payment for your hosting plan by its due date, your account will be cancelled for non-payment and you will not be able to access your Web site or e-mail.

When an account is cancelled, all copies of the Web site and e-mail files are permanently and irretrievably removed from our servers.

If an account has been suspended for non-payment, it will only be reactivated upon payment of all overdue fees.

If we make any refunds due to charges you dispute with your credit card company, we will cancel your account. The cancelled account will only be reactivated once all disputed/refunded fees are resolved satisfactorily, and we receive payment for any and all administrative fees incurred by EHOSTONE as a result of your dispute or charge-back request. We cannot guarantee any files or e-mail will be available upon reactivation.

It is a violation of this Agreement for you to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, and/or electronic checks. A determination of such misuse or fraudulent use shall be in our sole discretion. Further, we may report all such misuses and fraudulent uses (as determined by us in our sole discretion) to appropriate government authorities, credit reporting services, financial institutions and credit card companies. In these situations, you shall have waived any and all rights to privacy.

30 Day Money Back Guarantee restrictions

30 day money back is guaranteed for accounts with hosting only plans. Setup fee will not be refunded and we cannot refund domain registration payment due to price lock with our registrar, plus your account will be deducted with any other termination fee. However if you choose to host else where we will be happy to point your domain to your hosting account anywhere, after your one year registration period ends you are free to transfer your domain to anywhere but you have to do that before your domain expires.

If you would like to get a refund for any reason, please send an email to sales@ehostone.com all refund requests has to be done at least 10 business days before your account completes 30 day period, in-order for it to be processed.

If you signup for Monthly and Quarterly hosting: if you request full refund within or before 15days from the date your purchased your plan, your account will be deducted with appropriate fees based on the transaction (5% transaction fee and any surcharges)

Refunds

If you cancel your account after the 30days money back guarantee and or after you renew your account  you agree to forfeit any prorated charges paid to your account.

Domain Name Registrations and Renewals

Upon a Customer's request, and subject to these terms and conditions, EHOSTONE will attempt to register a domain name, or renew the registration of an existing domain name, on behalf of the Customer with any domain name registrar that EHOSTONE, in its sole discretion, elects to employ for such registration or renewal (the "Chosen Registrar"). EHOSTONE reserves the right to refuse any request for registration or renewal of a domain name.

The registration or renewal of any domain name by EHOSTONE on behalf of a Customer is subject to, and contingent upon, (i) the Customer providing all information needed to complete such registration, (ii) the availability of the domain name, (iii) the domain name not being in violation of any applicable law, rule, statute or regulation, (iv) the domain name not being in violation of any policy of the Chosen Registrar, (v) any fees or costs for such domain name registration being paid in advance by the Customer and (vi) the Customer's continued compliance with any and all EHOSTONE Terms of Service and the AUP.

Once a domain name has been registered or renewed through EHOSTONE, no refunds will be given for the domain registration or renewal fee.

The Customer has full ownership rights over any domain name registered or renewed through EHOSTONE, where the domain registration fees have been paid in full by the Customer. In the event of fraud or failure to pay fees, EHOSTONE will retain possession of the domain name. In addition, if we receive a credit card charge-back for a domain registered with us, EHOSTONE will take ownership of the domain name(s) registered.

EHOSTONE is not responsible for maintaining the registrant information for domain names. The domain owner can modify all this information using our Control Panel, by contacting our Support Team or contacting the Chosen Registrar. The Customer agrees to continually update all information required by the Chosen Registrar. Updating your information with EHOSTONE does not automatically update it with the Chosen Registrar.

EHOSTONE is not responsible for any domain name's availability. The Customer waives any and all claims against EHOSTONE for, and hereby releases EHOSTONE from, any loss, damage, liability, cost or expense arising out of, or relating to, the registration or release of a domain name.

The Customer acknowledges and understands that any and all domain name registrations and renewals are subject to the terms, conditions, rules, regulations, applicable law and policies of ICANN (Internet Corporation for Assigned Names and Numbers). In addition, any and all domain name registrations and renewals are subject to the terms and conditions of the Chosen Registrar, which can be found on the Web Site of such Chosen Registrar. Upon request, EHOSTONE will provide the Customer with the name of the Chosen Registrar.

The Customer understands and accepts that a request for a domain name registration or renewal is no guarantee that the Customer will receive the domain name that has been requested. The Customer understands, accepts and appreciates the risks associated with circumstances and vulnerabilities generally affecting the Internet and e-commerce in general. The Customer waives any and all claims it may have against EHOSTONE for, and hereby releases EHOSTONE from, any loss, damage, liability, cost or expense arising out of, or relating to, the registration or release of a domain name in such circumstances.

EHOSTONE is not liable for domain disputes that may arise over changed registrant information for a domain name.

EHOSTONE is not responsible for resolving any domain disputes. These issues must be resolved by the parties involved, according to the legal bounds of ICANN, the domain name governing body. EHOSTONE will not act as an arbitrator, but will honor any ICANN decisions.

If we are unable to secure payment before the domain renewal date, the domain name will expire.

Forty (40) days after a domain renewal date, a domain name will be released by the Registrar and made available to the general public for re-registration.

After a domain has expired, we will, upon a Customer's request, put in a request with our Registrar to renew and reactivate the domain name if all registration fees are paid (including any extra fees required to pull a domain name out of its redemption period). This process is normally complete within four (4) days.

If we receive a dispute of payment, a chargeback or a request for a refund from your credit card EHOSTONE for a renewed domain name, EHOSTONE will take over the ownership of the domain name in question.

The Customer agrees that any and all information provided in connection with any domain renewal request shall be true and correct in all respects. In connection with any such request, EHOSTONE assumes responsibility only for processing such renewal request with the Chosen Registrar. EHOSTONE disclaims any and all responsibility to verify any information provided in connection with the request and shall have no responsibility or liability for any loss, delay, inconvenience, interruption in service, service error or loss of data.

EHOSTONE bears no responsibility or obligation to notify Customer of any approaching domain name expiration dates. The Customer agrees to bear complete responsibility for such deadlines.

Responsibility

You are fully responsible to any web-sites you host on our servers. Any type of violations to rules will result in termination without refund.

AUP Enforcement

Violation of this web hosting agreement (the AUP) may subject Customer to international, federal, and/or state civil and/or criminal liability, including without limitation, California Business & Professional Code Section 17538.45. EHostOne.com reserves the right in its sole discretion and without prior notice to suspend and/or terminate Customer's access to the Service at any time for violating this AUP. EHostOne.com also reserves the right to suspend, filter or block, and/or terminate Customer's access if Customer's account is being used to exploit or attack the Service or the networks of others. If Customer's account has been compromised and attempts to reach Customer and/or to have Customer repair a breach of security fail, EHostOne.com reserves the right to suspend or terminate Customer's service. If Customer's access is suspended or terminated, EHostOne.com, in its sole discretion, may refuse to accept all new e-mail sent to the terminated e-mail address and delete Customer's data stored on Service. EHostOne.com will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.

Violations to following rules will result in termination of your account without refund:

Inappropriate Use

The Web Hosting Service must not be used to publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: threatening, harassing, defamatory, obscene, or fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute. The Service must not be used to request unlawful services or materials. The Service must not be used for activities EHostOne.com deems to impact its customers or its ability to deliver services to its customers. Such activities may include, but are not limited to:

Obscene Speech or Materials

The distribution of child pornography or any obscene, abusive, defamatory or threatening speech or material. You may not host any site containing adult oriented content, including nudity of any kind. Portal sites linking directly to adult oriented content are also not acceptable.

Intellectual Property Infringement

Any activity infringing on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents.

Spamming

Sending unsolicited commercial bulk email ("UCE"), news postings or chain letters, advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE, use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by EHostOne.com. EHostOne.com reserves the right to determine in its sole discretion what constitutes UCE based on the information available. Sending any email to purchased lists or lists obtained by any other method (such as harvesting) is not acceptable. Customers may only send email to recipients who have joined mailing lists directly from their web site.

Maintaining an Open Email Relay

Allowing email to be sent through Customer's system by a third party (i.e. neither to nor from Customer or Customer's accounts).

Fraud

Using a false identity, using pyramid/ponzi scheme, storage or transmission of any intentionally incorrect data or packet.

Virus, Worm, or Trojan horse program distribution

The deliberate transmission of computer viruses, worms or trojan software.

Denial of Service

Using any technique to intentionally degrade or disable the delivery of any legitimate data.

Glutting of servers

Oversized storage of any files that would be unreasonably large: ie. having hundreds of JPGS (such as cartoon or Japanese anim) are not allowed. There can be no applications stored in your web space, including but not limited to files with .exe extensions. Also, files typically used to store compressed data are not allowed. This is including but not limited to zip files. There can be no live video or audio feeds on your site...i.e. webcams.

Unauthorized Access

attempting to gain unauthorized entry to any site or network, or any network or host scanning, probing, monitoring or other information gathering associated with such activity; using the Service to guess passwords.

Applications

Customer may not run any program or script on the server that runs constantly or 'listens' on ports. This includes applications associated with live chat services.

Public Forums

Inappropriate postings to newsgroups, chat rooms, electronic bulletin boards and any other public forum on, or using, the Service.

Customer Responsibilities

Bulk Email

Customers may not send bulk email of any type other than email to their own subscribers. Safelists or any other rented or purchased lists are not allowed. The email subscriber must have joined your list from your site. Customer must include the source of the addressee's address in each email message.

CPU Usage

Sites may not use extreme unwarranted CPU usage. This includes usage of "heavy" scripts or Flash/shockwave files. By heavy we mean scripts that place consistent high demands on the server. This includes but is not limited to web traffic management scripts, traffic exchange scripts, surf for hits sites as well as large advertising management scripts or proxy server scripts. No single site may consume 25% of CPU usage for a sustained period of time.

Service Resale

Customer may not resell the Service or any portion of the Service.

Password Protection

Customer is responsible for protecting passwords and for any authorized or unauthorized use.

Music Files

Customer may not with out permission have sound/video files in any format (MP3, ASX, ASF, RA, RAM , QTV etc.) due to the high rate of illegal transfer of copy written material. Even with permission, there is a 5 file maximum on all audio and video files and each file must be smaller than 5 MB due to the demands they place on the server.

Content Protection

Customer agrees to provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material that Customer publishes via any Service.

Content Ownership

Customer is responsible for all content or information residing on, or obtained or transmitted via, the Service, regardless of whether such use is by Customer.

File repository / Dump Sites

Customer may not use disk space as a file repository, or dump site. This includes but is not limited too; warez, serialz, sound files, applications, zip files. This includes using the space in order to store content used on other sites (remote linking). Examples of this would be using the web space to store images for auction descriptions, flash or any other files used on another site but stored on our server. This also includes the hosting of 'sig' images for use on message boards. Customer may not exceed disk space allocated in hosting package. If customer exceeds the storage space specified in the hosting packaged, the account may be terminated.

Free Email / Hosting Sites

you may not re-sell your hosting space or email accounts to anyone.  Unless your in a reseller package or multi domain hosting package.

Name Parking

Customer may not use account to park domains. You MUST have an actual website to go with each of your domain names.

Facilitating AUP Violation

Customer activity that facilitates the violation of this AUP by any party constitutes a violation of this AUP by Customer.

LIMITATION OF LIABILITY:

EHostOne.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from servers going off-line or being unavailable for any reason whatsoever. Further, EHostOne.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of EHostOne.com servers. All damages shall be limited to the immediate termination of service.

EHostOne.com shall be the sole arbiter of what is and is not a violation of these acceptable use policies. EHostOne.com reserves the right to terminate an account at any time and for any reason that causes harm to any customer's web sites. EHostOne.com reserves the right to delete all content and files upon termination. EHostOne.com reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. EHostOne.com reserves the right to refuse, cancel, or suspend service at our sole discretion.

EHostOne.com reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these Policies does not constitute consent.

Affiliate Terms and Conditions

 

  1. Summary of Program: Under the Affiliate Program, you will be paid a referral fee ("Referral Fee") for each qualified customer ("Referral") that you refer to EHOSTONE under this Agreement. Each Referral needs to meet the following Criteria ("Criteria"):

     

    1. Each Referral must be a new and unique visitor to EHOSTONE and must register by completing and submitting the registration form using a valid and unique e-mail address.

       

    2. Each Referral must enroll in a qualified hosting plan or purchase a qualified product and provide a valid payment for the hosting services purchased. To generate a Referral Fee for you, each Referral must be an active, qualified customer of EHOSTONE and must be up-to-date in all payments at the time the Referral Fees are processed.

       

    3. Each Referral must signup in a manner, which in our sole judgment, definitively establishes that the Referral was referred directly from you to EHOSTONE under this Agreement.

       

    4. Each Referral must remain in compliance with our Terms of Service, Acceptable Use Policy and other policies that are active at the time the Referral Fees are processed.

       

    5. Referrals cannot be listed in the Client Manager of the ProRewards Program or signed up through a EHOSTONE Reseller Program.

       

    6. Referral Fees shall not be paid for Referrals that are fraudulent or have cancellations, terminations, charge-backs, refunds, outstanding balances or other adjustments.

     

  2. Permission To Use EHOSTONE Links: Under the terms of this Program, you will be granted a limited license to display EHOSTONE banners, buttons and/or hypertext (collectively referred to as "Links") on your Web site, e-mail, newsletter and/or other promotional materials. EHOSTONE grants you permission to download the EHOSTONE Links for placement on your Web site, provided you adhere to the terms and conditions set forth in the Agreement.

    You may only use Links to EHOSTONE on the Web site(s) that are listed in your application and approved by EHOSTONE. The maintenance of your site will be your responsibility. The information on EHOSTONE.com is frequently updated, and you may need to update the content of your Links regularly to maintain the accuracy of your site.

    On occasion, we may review your site to determine whether it is in compliance with the terms and conditions of this Agreement. We will notify you of any changes we feel should be made to ensure that your Links to EHOSTONE are appropriate.

    If you do not make the changes to your site that we feel are necessary, you may be terminated from the Affiliate Program.

     

  3. Link Guidelines:

     

    1. No Alterations Allowed: The Links, banners and images we provide must not be altered in any way. You can not change content, design, color, font, proportions or animation. The Links may be displayed in a larger size, but must be increased in size proportionally. EHOSTONE reserves the right to update, revise or alter the Links in any manner from time to time.

       

    2. Required Link: The Links must always link to a URL that is provided or approved by EHOSTONE.

       

    3. Positive Presentation: Your Web site must use the Links in a positive manner. The Links may not be used in a way that could disparage or reflect adversely on EHOSTONE or its products.

       

    4. You may not use the Links on any Web site that disparages EHOSTONE or its products or services, infringes upon any intellectual property or other rights of EHOSTONE, contains or promotes "adult", pornographic or obscene material or content, promotes gambling, or violates any state, federal or international law.

       

    5. Compliance With Laws: You may not use the Links if your Web site infringes any party's intellectual property or other rights, contains or promotes "adult", pornographic or other obscene material or any content prohibited by the EHOSTONE Acceptable Use Policy, or violates any state, federal or international law.

       

    6. You will be responsible for any claims, costs and damages incurred by EHOSTONE as a result of a violation of these Link Guidelines.

     

  4. Changes: We reserve the right to change this Agreement, including without limitation, the Links Guidelines and the Compensation, at our discretion. Changes will take effect when posted to the EHOSTONE Web site. If you do not agree to such changes, you may terminate this Agreement via e-mail notice to affiliates@EHOSTONE.com.

     

  5. We will pay a Referral Fee equal to the specified percentage or dollar amount of any revenue generated by a qualified Referral in the calendar quarter in which the Referral signs up with EHOSTONE account. Information about the specified commission rate will be available through the Affiliate Console section of the EHOSTONE Web site.

    You are responsible for informing EHOSTONE about changes to postal and e-mail addresses. Failure to provide the correct addresses may result in the forfeiture of any payments due to you. Payments that are returned for invalid or insufficient address information, may be forfeited as well.

    Referral fees are only paid through Pay-Pal to your account, as defined in this Agreement, approximately twice monthly only if the commission(s) being paid remain active the first 37 days.

    Referral Fees will be issued approximately twice monthly as long as the commission(s) being paid remain active the first 37 days . To qualify to receive payment, your Referral Fee must be at least $30.00. Based solely on the discretion of EHOSTONE, payment may be withheld for amounts under $30.00.

    You will only be compensated for Referrals that purchase EHOSTONE products via the Links you generate through the EHOSTONE Affiliate Console. Purchases made by Referrals who have clicked on these Links will be tracked by EHOSTONE for the purposes of this Affiliate Program. By altering these Links in any way, you may forfeit corresponding Referral Fees.

    Any attempt by an Affiliate to manipulate, falsify or inflate Referrals, to defraud EHOSTONE, or to violate the terms of this Agreement constitutes immediate grounds for EHOSTONE to terminate this Agreement and will result in forfeiture of any Referral Fees due to you.
